Adventure Media / Terms of Use

Clear terms. No mystery math.

These Terms govern use of Adventure Media websites and website-based services. Purchases, campaigns, production work, and custom projects may also be governed by the proposal, order, checkout terms, statement of work, or agreement accepted for that service.

01 / Agreement and scope

Using the site means accepting the rules.

By accessing or using an Adventure Media website, submitting information, using Sophie, creating an account, completing checkout, or purchasing a service, you agree to the terms that apply to that activity.

Service-specific terms control when they are more specific.

If a signed agreement, proposal, order, checkout screen, statement of work, insertion order, or product-specific term conflicts with these general website terms, the more specific accepted term controls for that service.

02 / Acceptable use

Use the tools. Do not misuse them.

Adventure Media provides this website to explain services, answer questions, support customers, accept approved purchases, and help visitors reach useful next steps.

01 / LAWFUL

Use the website legally

Do not use the website, Sophie, forms, checkout, or communications to violate law, infringe rights, deceive others, harass people, or distribute unlawful material.

02 / ACCURATE

Provide truthful information

Information submitted for an inquiry, appointment, purchase, campaign, account, transfer, or requested follow-up must be accurate and authorized.

03 / SECURE

Protect access

You are responsible for safeguarding account credentials, devices, payment access, and links provided for your use, and for notifying Adventure Media of suspected misuse.

04 / STABLE

Do not disrupt systems

Do not probe, scrape, reverse engineer, overload, bypass safeguards, introduce malicious code, or interfere with the website, network, AI, forms, tracking, or connected services.

05 / AUTHORIZED

Act with permission

Do not submit another person’s information, content, payment method, business materials, or instructions unless you have authority to do so.

06 / ENFORCED

Access may be limited

Adventure Media may restrict or end access when reasonably necessary to protect people, systems, rights, customers, or the integrity of its services.

03 / Sophie and AI

Helpful intelligence still needs judgment.

Sophie and other AI-enabled experiences may answer questions, explain services, navigate pages, preserve context, collect information you choose to provide, and help complete requested actions.

What Sophie may do

  • Answer questions using approved Adventure Media knowledge
  • Recommend relevant pages, sections, services, or next steps
  • Help book, route, qualify, or request follow-up
  • Use conversation and page context to make the experience more useful

What Sophie may not replace

  • A signed agreement, approved proposal, invoice, or checkout term
  • Legal, medical, financial, tax, or other professional advice
  • Human review for custom pricing, unusual commitments, disputes, or unsupported claims
  • Secure payment pages; do not provide complete card details in chat
AI responses can be incomplete or inaccurate.

Verify important information before relying on it. Adventure Media may correct or clarify an AI response, and no AI statement changes an accepted agreement unless Adventure Media confirms the change in writing through an authorized representative.

04 / Purchases and commitments

The selected term is the commitment.

Review the package, price, billing schedule, duration, deliverables, and accepted terms before completing a purchase.

Fixed-term packages and monthly billing

When you select a fixed-term package and complete checkout, you accept a binding commitment for the full selected term. Monthly billing is a payment convenience and does not convert the purchase into a month-to-month service. The purchaser remains responsible for the full selected term.

All sales and refunds

All purchases are final unless Adventure Media states otherwise in writing. Payments already made are non-refundable unless required by law or approved by Adventure Media in writing. Services, inventory reservation, planning, campaign preparation, or production work may begin shortly after purchase.

Cancellation and nonrenewal

Early cancellation does not remove the obligation to pay for the full accepted term. To prevent renewal after the term ends, the authorized purchaser or billing contact must submit written cancellation notice at least 30 days before the next billing cycle to info@adventmedia-co.com or by mail to 645 Everhart Rd, Corpus Christi, TX 78411.

Failure to use services or provide materials

A purchaser’s failure to use a service, respond, approve materials, supply required assets, or complete onboarding does not automatically pause billing, extend the term, or remove payment obligations unless Adventure Media agrees otherwise in writing.

Taxes, fees, and payment handling

The purchaser is responsible for applicable taxes and clearly disclosed charges associated with an accepted order. Payment information must be submitted through an approved secure checkout, invoice, payment link, or payment page—not through Sophie or ordinary website messages.

Custom services

Custom creative, AI, website, CRM, lead-generation, Direct Mail, media, strategy, and other scoped work may require a separate proposal, deposit, timeline, approval process, or agreement. The accepted project document defines the controlling scope and pricing.

05 / Content and ownership

Your claims must be true. Our tools remain ours.

Advertising and production work depends on accurate materials, timely approvals, and clear ownership boundaries.

01 / CLIENT MATERIALS

Your materials

You retain ownership of content you lawfully provide. You grant Adventure Media the permission needed to review, edit, format, produce, distribute, display, and otherwise use it to perform the requested services.

02 / CLAIMS

Your responsibility

The purchaser is responsible for ensuring advertising claims, offers, prices, testimonials, disclosures, permissions, and supplied materials are truthful, accurate, legal, and compliant.

03 / REVIEW

Our right to reject

Adventure Media may reject, pause, remove, or request changes to content it reasonably believes is unlawful, misleading, infringing, unsafe, unsuitable, or inconsistent with an approved network or service.

04 / METHODS

Adventure Media property

Adventure Media retains its pre-existing templates, processes, methods, systems, raw footage, project files, production materials, technology, code, know-how, and brand assets.

05 / DELIVERABLES

Final approved work

After all amounts owed are paid, the purchaser may use final approved deliverables for its business subject to the accepted agreement. Raw files and working files are not included unless expressly stated.

06 / PORTFOLIO

Portfolio use

Adventure Media may use approved creative work for portfolio, marketing, and promotional purposes unless the client opts out in writing or a separate agreement states otherwise.

Production revisions

Standard production packages include two revisions unless the accepted agreement states otherwise. The agreement controls what qualifies as a revision, and additional revisions may require added time or cost.

06 / Results and availability

We provide the work. We do not invent the outcome.

Advertising and business performance depends on factors that no honest provider controls alone.

No guaranteed business result

Unless a specific written term states otherwise, Adventure Media does not guarantee sales, leads, calls, clicks, traffic, revenue, rankings, appointments, or another particular business result. Performance may depend on audience, market, offer, creative, budget, competition, follow-up, customer service, timing, platform changes, and other conditions.

Specific written commitments still matter

Some approved Streaming Network packages include defined impression commitments and Proof of Play reporting. Those specific commitments are governed by the package or agreement accepted for the campaign and should not be confused with a guarantee of sales or revenue.

Availability

Adventure Media may update, suspend, replace, or discontinue website features or service components when reasonably necessary.

Third-party services

Connected platforms, payment processors, embedded services, and external links are also governed by their providers’ terms and availability.

Delays outside reasonable control

Adventure Media is not responsible for delays caused by events outside its reasonable control, including outages, platform changes, supply issues, venue conditions, severe weather, government action, or failures by third parties.

Changes and maintenance

Maintenance, security work, upgrades, or emergency changes may temporarily affect access. Reasonable efforts will be made to restore affected services.

07 / Legal terms

The serious part, kept readable.

These provisions define important limits and the process for resolving a disagreement.

Website provided as available

The website and general informational content are provided on an “as available” basis. To the fullest extent permitted by law, Adventure Media disclaims implied warranties relating to the website, including merchantability, fitness for a particular purpose, and noninfringement. Specific written warranties in an accepted agreement remain subject to that agreement.

Limitation of liability

To the fullest extent permitted by law, Adventure Media will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for lost profits, lost revenue, lost data, lost opportunities, or business interruption arising from website use. Any service-specific liability limitation in an accepted agreement controls for that service.

Your responsibility for claims

You are responsible for losses, claims, or expenses arising from materials you supplied, instructions you authorized, unlawful website use, infringement of another party’s rights, or a breach of these Terms, to the extent permitted by law and subject to any controlling written agreement.

Good-faith resolution first

Before filing suit, the parties agree to make a good-faith effort to resolve the dispute for at least 10 business days after written notice describing the issue and requested resolution.

Texas law and Nueces County

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any lawsuit relating to these Terms will be brought in the state courts located in Nueces County, Texas, unless applicable law requires otherwise.

Severability, waiver, and assignment

If a provision is found unenforceable, the remaining provisions remain effective. A failure to enforce a provision is not a waiver. You may not transfer your rights or obligations without Adventure Media’s written consent; Adventure Media may transfer these Terms as part of a reorganization, financing, sale, or transfer of the relevant business or assets.

08 / Other important details

A few final things before the footer.

Still binding. Still written like a person might actually read it.

Privacy

Adventure Media’s Privacy Policy explains how personal information may be collected, used, protected, and processed. The Privacy Policy is incorporated into these Terms by reference.

Electronic communications

You agree that website notices, checkout records, approvals, confirmations, invoices, and other communications may be provided electronically where permitted. Marketing communications remain subject to applicable consent and opt-out requirements.

Entire agreement

These Terms, the Privacy Policy, and any accepted service-specific document form the agreement governing the applicable activity. They replace prior discussions about the same subject to the extent those discussions are not included in the accepted written terms.

Updates to these Terms

Adventure Media may update these Terms to reflect changes in law, technology, services, or business practices. The effective date will be updated when revised Terms are published. Continued use after an update means the revised website terms apply going forward; existing purchases remain subject to the terms governing them when accepted unless the parties agree otherwise.

09 / Questions and notices

Questions should reach a real address.

Contact Adventure Media with questions about these Terms, purchase commitments, cancellation notices, or service-specific agreements.

Cancellation notices must come from the authorized purchaser or billing contact and remain subject to the applicable accepted agreement.

Effective date: July 19, 2026. If you do not agree to these Terms, do not use the website or complete a purchase. Questions about a specific order should reference the accepted package, proposal, invoice, or agreement.
